Many others have done this, but I have been lurking and would like to compile a list of requested characters that I feel have the best possible chances.
First, I want to say that the game IMO will most definitely have less than 40 characters. Sakurai said himself creating 26 characters for Melee was a HUGE challenge.
Secondly, I am basing this lists chances on 3 things....Popularity, Retro value, and Capable move lists.
If you are a popular character...you have a chance to be in brawl
If you are a retro Nintendo character...you have a chance to be in brawl
and if you actually could have LEGITIMATE!!! moves....you could also be in brawl
I will be judging all of the characters based on those 3 points...
:MARIO:
1: Mario: Confirmed
2: Luigi: Luigi is 100% Definitely going to be in brawl. If He is not, I will eat my own shoe, I promise. He will be totally redesigned with a unique move set...I am going to make a prediction that just like Mario's flood, his Down-B move will be the Vacuum and that it will not be his permanent weapon
3: Bowser : Confirmed
4: Peach - : Confirmed
5: Yoshi -: Confirmed
6: Wario: Confirmed
:ZELDA:
7: Link : Confirmed
8: Zelda - C: Confirmed
9 Ganondorf: now...don't everyone flame me here...but I have a feeling with the subspace army adventure mode, Ganondorf might be a Boss encounter. We all already know he is in the game due to the IMDB voice actor listed on the Brawl page. He could possibly be playable using his Twilight princess look wielding his sword.
10: Cel Shaded link : With the storm rage of people who expressed they wanted young link to stay in the game...i think he will be back as the Cel shaded form with a wind waker style move set. The only proof I have of this is The Tingle trophy in one of the updates. He is cel shaded. There was also that bogus "radio interview" that we all know was most likely fake because of the return of the ice climbers

12: Meta knight: Confirmed
13: King DeDeDe: This is definitely a no brainier. No. 1 on the polls, his creator is the director of the game...blah blah blah hell be in.

16: Fox : Confirmed
17: Falco/Krystal/Wolf: Here is a hard one. Sakurai stated that clone characters would either be thrown away or revamped....I am not sure there is anything they can do with Falco that isn't the exact same as Fox. People have Mentioned his "Assault Look" with his bazooka...but I'm sure that would be very awkward move set for a guy in a jumpsuit to run around with a bazooka that isn't Snake. I will say the same for Wolf. What can he do that would be so different than fox...there really is nothing. The best bet for another Star Fox rep is Krystal....Now I HATE Krystal..hate her....not to mention the game she debuted in was one of the worst games I have ever played. That does not stop the fact that she was high on the polls and would be totally unique and different than fox...not to mention shes a female rep...she will most likely make the cut.
:METROID:
18: Samus/Zero suit: Samus is Already confirmed
19: Ridley: This is the most on the fence character on my list....I was going to put him down as a boss encounter, but I have a feeling he will be playable. Everyone always says "THE METROID SERIES IS UNDER REPRESENTED!!!".....ughh...ya know why? Because there is not many interesting major characters in the series to begin with. The only one that actually stands out is Samus. I do however feel that the enormous support Ridley got during the development of the game really helped and you will see the big flying freak in brawl as playable

20: Pokemon Trainer: Confirmed
21: Pikachu : Confirmed
22: Jigglypuff: Jiggly is most likely going to return in brawl because of how unique and fun she was in the previous games. Come on....who didn't do a 1v1v1v1 jiggly sleep murder fest match with their friends at one point?
23: Mewtwo/Luccario: Okay.....let me get one thing off my chest people...Pokemon is the most AWFULLY over represented series in ANY of the smash games......I find it very annoying that people keep talking about MORE Pokemon when there have already been 6-7 confirmed Pokemon in Brawl (including poke balls). I am going to bet that there will be at least 15 in total....and if you think that is a drought of Pokemon characters...please.......just please. With that said I do not think Luccario will make a debut because of Sakurai's love for the first generation. Expect to see Mewtwo redesigned with a better move set. The only thing that will bring Luccario in would be his popularity...which could say a lot
:FIRE EMBLEM:
24: Ike: Confirmed
25: Marth: Why do I think Marth will return? He was one of the most popular characters from Melee, and He and Roy being in the game sparked HUGE interest in Fire Emblem state side. I would be very surprised to see him gone
26: Micaiah: The only reason I feel she will get in over Black Knight is simple...there are barely any magic users in brawl....lots of sword users....there aren't very many females in brawl....lots of dudes.......One could also argue that is why Lyn was going to be in....but as you see she used swords so she really only had about a 50% chance.
:EARTHBOUND/MOTHER:
27: NESS:: I think it would be foolish to replace him with recently confirmed Lucas...As much as we all thought it would happen....I have a feeling Ness is still going to be in the game as a playable character. That is as far as the Earthbound/Mother series will go though. I don't see anyone else making the cut

:OTHER:
29: Captain Falcon: With Samurai Goroh confirmed as assist trophy...Captain Falcon is definitely in Brawl as playable
30: Ice Climbers: Confirmed
31: Pit : Confirmed
32: Game and Watch : Though I really don't believe in the whole Icon theory...game and watch will be in the game once again as a tribute to his creator who passed away during Melee's Development. Also being th First ever Nintendo character doesn't hurt your chances
33: Olimar: Top requested character in the polls and all around popular character...The only thing keeping him out is the fact that he would have an EXTREMELY strange and awkward move set.
34: Animal Crossing MC: We have all seen the interview with the AC guy saying there will be a playable AC rep...and yes i believe it is true. The only viable option would be the MC because everyone else in the series has practically been deconfirmed...although don't rule out everyone because it would be really weird selecting the MC and the announcer yelling "ANIMAL CROSSING MAIN CHARACTER!!!"....so this one may be still on the fence
35: Sukapon: Being in the first fighting game for Nintendo, being highly requested on the polls, genuinely being a very unique and funny character, and Sakurai loving the retro gives this pink limbless blob a hell of a lot of chances to be playable.
:3RD PARTY:
36: Snake: Confirmed
for the remaining 1-2 spots for 3rd party representatives... I will take a look at the most popular suggestions and break them down then give my assessment.
Sonic: Now...I know he is the number one requested character for this game and he is ridiculously popular, but SEGA already has a game coming out (Mario and Sonic at the Olympic Games) witch was supposed to be the first time they crossed universes with Nintendo.....I remember when they first announced that game was in development people were like "OMG MARIO AND SONIC TOGETHER IN A GAME FOR THE FIRST TIME OH GOODNESS!!." Now, do you think SEGA is just going to hand over their beloved mascot for ANOTHER Nintendo based game? I think not...SEGA would probably say something like...."why don't you buy him from us if you wanna use him so much?" I just see the integrity of SEGA being turned into a doormat if they put sonic in brawl..its just another reason for them to have the "Nintendo OWNS us now" type of attitude. He would have a great move set and would fit in so nicely..i just don't see it happening.
Megaman: Here is another 3rd party mascot that MIGHT make it but I don't personally think so. Not that i doubt his coolness and popularity seeing as how he started on Nintendo and was a huge hit ONLY on Nintendo systems. The main problem is he would cost a hell of a lot of money and all he would really be is a little blue suited boy version of Samus. He could be given a move set..but he is too similar to other characters. I am not going to rule him totally out though because of his immense popularity and fan service factor..but i am just not sure.

: Okay...the most likely third party Character out of all of the suggestions is this guy. he is the ONLY 3rd party suggestion to be a main character IN a Mario game...He was in the top 5 most requested on the polls, and Sakurai has mentioned him many times... He is very unique and his move set would be easy to construct seeing as he has all kinds of star guns, laser beams and rocket arms. The only thing holding his guy back is Square-Enix....Ya we know Nintendo and SE are starting to come out of the once shaky relationship...but nevertheless...he is still owned by them and they could just simply say....no
Pac Man: The Man Of Pac in my opinion has a decent chance to be in brawl. Nintendo and Namco have already collaborated together making a Mario Kart for the Arcade and Pac Man was a playable character, So Him being one of the only 3rd party suggestions that have actually played alongside Nintendo characters is a plus. Also Namco and Nintendo have very good relations...He would have a VERY hard move set to create, which somewhat rules him out because he does not really do anything but.....eat....pebbles...but who knows
Simon Belmont: This guy has a MUCH higher chance than you would think seeing as how Konami seems to be right on board with the idea of Snake joining the fight...he would be very unique and his whip would be something we have never seen before unless you count ZSS.
After everything is said and done...I will have to go with Geno and Simon Belmont as the 37th and 38th characters. remember, this is all just my personal opinion on what the brawl roster will be.
