Morris County Assistant Prosecutor Alissa Hascup has recommended that Fonseca be sentenced to five years in state prison. He would be eligible for parole after serving about one year and faces deportation to his native country of Honduras upon release, the judge noted.

Defense lawyer Jessica Moses said she discussed a possible defense of intoxication with Fonseca but that strategy is moot because he accepted a plea bargain. He is due to be sentenced July 30.

Through a Spanish-to-English interpreter, Fonseca admitted that he was drinking at the Speedwell Avenue pub and turned against officers as they approached to ask him to leave. Police have said they were called by the bar owner after Fonseca refused to leave in the early morning hours of Oct. 25.
